Please read these Terms carefully. By accessing or using our website or services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

These Terms and Conditions (“Terms”) govern your access to and use of the Fours Media website located at foursmedia.com and any services provided by Fours Media, LLC (“Fours Media,” “we,” “us,” or “our”), a limited liability company based in Petaluma, California.

1. Use of the Website

By accessing our website, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others.

You agree not to:

  • Use the website for any unlawful or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the website or its related systems
  • Transmit any harmful, offensive, or disruptive content
  • Copy, reproduce, or redistribute any content without our prior written consent
  • Use any automated tools to scrape, crawl, or extract data from the website
  • Impersonate Fours Media or any of its employees, partners, or affiliates

We reserve the right to terminate access to the website for any user who violates these Terms.

2. Services

Fours Media provides creative agency services including but not limited to video and photo production, paid media management (Google Ads, Meta Ads), search engine optimization, web development, brand strategy, and the Content Vault subscription service.

The specific scope, deliverables, timelines, and fees for any service engagement are governed by a separate Service Agreement or Statement of Work entered into between Fours Media and the client. These Terms apply generally to your use of our website and initial engagement with our business.

Content Vault Subscription

The Content Vault is a monthly content subscription service. Subscription terms, pricing, deliverables, and cancellation policies are outlined in the Content Vault Service Agreement provided at the time of enrollment. Subscriptions renew monthly unless cancelled in accordance with the terms of that agreement.

No Guarantee of Results

Fours Media makes no guarantee of specific business outcomes, revenue increases, lead generation targets, or return on ad spend. Any results referenced in our marketing materials, case studies, or testimonials are illustrative and not representative of average or expected results. Individual results will vary based on market conditions, offer quality, budget, implementation, and other factors outside our control.

3. Payment Terms

Payment terms for services are specified in your individual Service Agreement. General terms include:

  • Invoices are due upon receipt unless otherwise specified in writing
  • Late payments may be subject to a 1.5% monthly late fee
  • Fours Media reserves the right to pause or terminate services for accounts with outstanding balances
  • All fees are non-refundable unless otherwise stated in a signed Service Agreement
  • Ad spend paid to third-party platforms (Google, Meta, etc.) is separate from Fours Media management fees and is the client’s responsibility

4. Intellectual Property

Our content

All content on this website — including text, graphics, logos, images, videos, and code — is the property of Fours Media, LLC or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.

Client content and work product

Unless otherwise specified in a signed Service Agreement, creative work product developed by Fours Media for clients (including videos, photos, graphics, copy, and ad creative) becomes the property of the client upon receipt of full payment. Fours Media retains the right to display work in its portfolio and marketing materials unless the client requests otherwise in writing.

Client-provided materials

By providing us with content, images, logos, or other materials, you represent that you own or have the right to use those materials and grant Fours Media a license to use them in connection with providing our services.

5. Confidentiality

Each party agrees to keep confidential any non-public information shared in the course of a service engagement, including business strategies, financial information, client data, and proprietary processes. This obligation survives the termination of any service agreement. Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Fours Media, its officers, employees, partners, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Damages arising from your use of or inability to use our website or services
  • Errors or omissions in any content on our website
  • Unauthorized access to or alteration of your data
  • Third-party platform changes, policy updates, or account suspensions (including Google Ads and Meta)

In no event shall Fours Media’s total liability to you exceed the total fees paid by you to Fours Media in the three (3) months preceding the claim.

7. Disclaimer of Warranties

Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied. Fours Media does not warrant that:

  • The website will be uninterrupted, error-free, or free of viruses or other harmful components
  • Any information on the website is accurate, complete, or current
  • Our services will meet your specific expectations or requirements
  • Any advertising campaigns will achieve specific results or return on investment

8. Indemnification

You agree to indemnify, defend, and hold harmless Fours Media and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our website or services; (b) your violation of these Terms; (c) any content you provide to us; or (d) your violation of any third-party rights.

9. Third-Party Platforms and Services

Our services often involve managing accounts and campaigns on third-party platforms including Google Ads, Meta Ads Manager, Instagram, Facebook, and others. Fours Media is not responsible for:

  • Policy changes or enforcement actions by these platforms
  • Account suspensions, ad disapprovals, or platform-side issues
  • Downtime, outages, or technical issues on third-party platforms
  • Changes to algorithm behavior that affect campaign performance

Clients are responsible for maintaining access to and ownership of their own advertising accounts. Fours Media operates as a third-party manager and does not take ownership of client accounts.

10. Termination

Either party may terminate a service engagement as outlined in the applicable Service Agreement. Fours Media reserves the right to terminate or suspend access to the website or services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to Fours Media, other users, or third parties.

Upon termination of services, Fours Media will provide the client with any deliverables completed and paid for. Outstanding balances remain due.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sonoma County, California, and you consent to the personal jurisdiction of such courts.

Prior to initiating any legal action, both parties agree to make a good-faith effort to resolve any dispute through direct negotiation for a period of 30 days.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Entire Agreement

These Terms, together with any applicable Service Agreement and our Privacy Policy, constitute the entire agreement between you and Fours Media with respect to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether oral or written.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
